He obtained his Juris Doctor from Osgoode Hall in 2008 and then articled at a prominent Toronto insurance defence firm before returning to the Midland area to focus on plaintiff personal injury and insurance matters.</p>
<p>Dale has experience litigating serious motor vehicle accident claims as well as slip and fall, occupier’s liability, product liability, and long-term disability claims.  He has successfully argued before the Ontario Superior Court of Justice, the Ontario Small Claims Court as well as a various levels of Tribunals.</p>
<p>Born and raised in the Midland area, his knowledge of the community and the people who live there combined with his experience working in both large urban and small rural firms makes him a real asset to his clients.  His experience articling with a large insurance defence firm provides him with a unique understanding of how insurers approach litigation.  Dale understands the challenges his client’s face and knows how to achieve the best possible results for them.</p>

			<content:encoded><![CDATA[<p>On April 2, 2012, Justice Richetti of the Superior Court of Justice released his decision in De Marco v. The Dominion of Canada General Insurance Company.  In this application, DeMarco brought an application against Will Davidson&#8217;s client, The Dominion, seeking a declaration that The Dominion had an obligation to defend and indemnify its insured against a lawsuit brought by its landlord for contamination to a Gas Station which had allegedly occurred over a period of many years.</p>
<p>In Court, Chris Morrison and Stephanie Quesnelle argued on behalf of The Dominion that it had sold a policy of insurance for a premium that was based on not having to respond to claims of this nature, that the policy was clear and unambiguous and that the entire claim was excluded.</p>
<p>Justice Richetti agreed with these submissions noting that The Dominion was an &#8220;innocent&#8221; party in these transactions and should not have to cover a risk it clearly had excluded.</p>

McCarthy, on the occasion of his appointment as a Judge to the Superior Court of Justice in the Province of Ontario.  Justice McCarthy has long been associated with the lawyers at Will Davidson LLP and became Counsel to the firm in 2006.  He has contributed immensely to the social and intellectual fabric of the firm and to the advancement of law in the Province of Ontario.  We wish Justice McCarthy the very best as he commences his new career on the Bench.</p>
