Oxford Living Class Action Lawsuit
No group of people in Ontario has been more vulnerable to the COVID-19 pandemic than the residents of long-term care facilities and nursing homes. On January 31, the Province of Ontario warned long-term care homes that residents were more at risk from the virus than other Ontarians. On March 11, the World Health Organization (WHO) declared a global pandemic. On March 28, the province limited social gatherings to groups of five people or less under its Emergency Management and Preparedness Act. That same night, Lundy Manor hosted a ‘pub night.’ Two days later, the local health unit announced an outbreak at the facility; 18 Lundy Manor residents had died from COVID-19 as of May 7.
One Lundy Manor employee said: “I could see there was a big problem with people sick, not isolating… Lundy Manor was a time bomb.”
“These residents should have been isolated and protected,” added Gary Will in his statement. “Instead they ate their meals in crowded dining rooms without physical distancing until the end of March. They were playing cards and participated in a pub night on March 28, 2020.”
Lundy Manor’s failure to provide appropriate care amid COVID-19 fits into a long-term pattern of neglect and abuse at Ontario’s nursing homes.
