Rosslyn Class Action Lawsuit
Will Davidson LLP is engaged in the investigation stages of a class action lawsuit against Rosslyn Retirement Residence in Hamilton, Ontario, for its handling of a COVID-19 outbreak that swept through the facility.
By May 15th, 64 residents and 22 staff members at Rosslyn were infected with COVID-19, and 14 residents had passed away. Several residents were relocated to St. Joseph’s Healthcare Hamilton. Winnie Doyle, St. Joseph’s Executive Vice President, told the media that “the home wasn’t meeting the safety standards that needed to be met.” She also described Rosslyn’s COVID-19 outbreak as a “very serious concern.”
Substandard care is nothing new in Ontario’s long-term care facilities. For years, Will Davidson LLP has represented plaintiffs in a range of nursing home negligence cases. However, the novel coronavirus COVID-19 has proven to be an unprecedented threat. The deficiencies that exist within the province’s long-term care system have been highlighted by the virus’s uniquely dangerous effects on seniors.
Our Rosslyn class action investigation has focused on the role that facility operators played in exacerbating the outbreak. It is our belief that the COVID-19 virus could have been contained through proactive planning and strict adherence to the province’s pandemic guidelines.
The Rosslyn class action may also address the fact that the facility has lost its license. Residents and their families will be forced to find new accommodations, a difficult task in these unprecedented and turbulent times.
In addition to our Rosslyn class action, Will Davidson LLP has either filed claims or initiated investigations into the following Ontario long-term care facilities and operators:
- Chartwell Retirement Residences
- Holland Christian Homes
- Ina Grafton Gage Home in Scarborough, Ontario
- Orchard Villa Long Term Care in Pickering, Ontario
- Oxford Living, the owner of Lundy Manor in Niagara Falls, Ontario
- The Village of Erin Meadows in Mississauga, Ontario
